QUICK REFERENCE #31: What is a drug court?

Drug courts are courts that have the particular responsibility of handling cases which involve substance-abusing offenders. Drug court programs, which have been in existence since 1989, may include drug testing, comprehensive supervision, treatment, sanctions, or incentives. Data indicate that (a) over 400,000 offenders have participated in drug court programs; (b) while participating in drug court programs, there is a decrease in drug use and criminal behavior; (c) recidivism rates for those who complete a drug court program is substantially lower than the 48% reported for those who do not participate.(1)

“Drug courts combine intensive judicial supervision, mandatory drug testing, escalating sanctions, and treatment to help substance-abusing offenders break the cycle of addiction—and the crime that often accompanies it. Drug court judges work with prosecutors, defense attorneys, probation officers, and drug treatment specialists to determine appropriate treatment for offenders, monitor their progress, and ensure the delivery of other services, like education or job skills training, to help offenders remain crime- and drug-free.”(2)
